Welcome to Cosmance. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Cosmance, operated by Alexander Zyryaev ("Cosmance," "we," "us," or "our"). By accessing or using the Cosmance website at cosmance.co, the Cosmance mobile application (the "App"), or any related services (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, you must not access or use the Service. Your continued use of the Service following any modifications to these Terms constitutes your acceptance of such changes.
Cosmance is a relationship compatibility platform that generates personalized compatibility reports based on astrological birth data, including sun sign, moon sign, Venus sign, Mars sign, and rising sign placements. The Service may also include daily horoscopes, birth chart analysis, weekly sign readings, and AI-powered question-and-answer features.
The Service is available through the Cosmance website and the Cosmance iOS application. Features and availability may vary by platform and subscription tier.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes on devices that you own or control.

This license does not grant you any ownership interest in the Service or its content.
You must be at least 13 years of age to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
When you create an account, you agree to provide accurate and complete information and to keep this information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
We reserve the right to suspend or terminate your account at our discretion if we believe you have violated these Terms or if your account activity poses a risk to the Service or other users.
Payments for reports and subscriptions made through the Cosmance website are processed by Stripe, Inc. By making a purchase, you agree to Stripe's Terms of Service. All prices are displayed in the applicable currency at the time of purchase.
Purchases made within the Cosmance iOS application are processed through Apple's in-app purchase system and managed via RevenueCat. These purchases are subject to Apple's Media Services Terms and Conditions.
Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date. For iOS subscriptions, you may manage and cancel subscriptions through your Apple ID account settings. For web subscriptions, you may manage your subscription through your Cosmance account settings or by contacting us.
For purchases made through the iOS App, refund requests are handled by Apple in accordance with their refund policies. For purchases made through the website, please contact us at [email protected] within 14 days of purchase. Digital content that has already been fully delivered may not be eligible for a refund.
You agree not to use the Service to:
All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, images, audio, software, and the underlying code — are owned by Cosmance or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
The Cosmance name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Cosmance. You may not use these marks without our prior written permission.
Birth data you provide remains your information. However, you grant Cosmance a non-exclusive, worldwide license to use such data solely for the purpose of providing and improving the Service.
The Service may contain links to or integrate with third-party services, including but not limited to OpenAI (AI content generation), Stripe (payment processing), RevenueCat (subscription management), Apple (App Store and in-app purchases), and Beehiiv (email communications).
We are not responsible for the content, privacy policies, or practices of third-party services. Your use of such services is governed by their respective terms and policies. We encourage you to review the terms and privacy policies of any third-party service you access through or in connection with Cosmance.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, COSMANCE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We make no warranty regarding the quality, accuracy, timeliness, or completeness of any content available through the Service.
Cosmance is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the application to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the Service.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COSMANCE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED EUROS (€100).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
You agree to indemnify, defend, and hold harmless Cosmance and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you submit or transmit through the Service.
These Terms are effective until terminated by you or by Cosmance. You may terminate your use of the Service at any time by discontinuing use and, if applicable, deleting your account.
We may suspend or terminate your access to the Service at any time, without prior notice or liability, for any reason, including but not limited to your breach of these Terms. Your rights under these Terms will terminate automatically if you fail to comply with any of their provisions.
Upon termination, your license to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property, warranty disclaimers, limitations of liability, and indemnification.
The following additional terms apply when you access the Service through the Cosmance iOS application downloaded from the Apple App Store. These terms are required by Apple and shall take precedence over any conflicting provisions in these Terms with respect to Apple-related matters.
These Terms are concluded between you and Cosmance only, and not with Apple Inc. ("Apple"). Cosmance, not Apple, is solely responsible for the Cosmance application (the "Licensed Application") and its content. These Terms may not provide for usage rules that conflict with the Apple Media Services Terms and Conditions as of the effective date of these Terms.
The license granted to you for the Licensed Application is a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
Cosmance is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in these Terms or as required under applicable law. You and Cosmance acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
Cosmance is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Cosmance's sole responsibility.
You and Cosmance acknowledge that Cosmance, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of the Licensed Application, including but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
You and Cosmance acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual property rights, Cosmance, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You and Cosmance acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms as they relate to your license of the Licensed Application, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

These Terms shall be governed by and construed in accordance with the laws of the French Republic, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Paris, France.
If you are a consumer residing in the European Union, you retain any mandatory rights granted to you under the consumer protection laws of your country of residence.
We reserve the right to modify these Terms at any time. When we make changes, we will update the "Effective Date" at the top of this page and, where required, notify you through the Service or via email. Your continued use of the Service after any such modifications constitutes your acceptance of the updated Terms.
